DMCA / Copyright Takedown Policy

1. Our Commitment

We take intellectual property rights seriously. We will respond expeditiously to claims of copyright infringement committed using our Services that are reported to our designated Copyright Agent. We will also take appropriate action against repeat infringers in accordance with applicable laws.

2. Filing a Copyright Infringement Notice

If you believe that any content available through our Services infringes your copyright, you may submit a written notification to our Copyright Agent containing the following information as required by the DMCA (17 U.S.C. § 512):

1. Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, you may provide a representative list of such works.
2. Identification of the infringing material and information reasonably sufficient to permit us to locate the material. Please provide specific URLs, game names, or descriptions of where the material can be found within our Services.
3. Your contact information, including your full legal name, mailing address, telephone number, and email address.
4. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
5. A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
6. Your physical or electronic signature.

3. Counter-Notification Procedure

If you believe that content you posted was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with our Copyright Agent. Your counter-notification must include:

1. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
2. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
3. Your full legal name, address, telephone number, and email address.
4. A statement that you consent to the jurisdiction of the courts in the Republic of Zambia and/or the federal district court for the judicial district in which your address is located, and that you will accept service of process from the person who provided the original notification of alleged infringement.
5. Your physical or electronic signature.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Visionary Tech Studios maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat copyright infringers. We may also terminate access to our Services for users who repeatedly violate intellectual property rights.

6. Modifications to Our Services

Upon receipt of a valid DMCA notice, we will act expeditiously to remove or disable access to the allegedly infringing content. We may also notify the alleged infringer of the takedown and provide them with information about filing a counter-notification.

7. Our Own Intellectual Property

Visionary Tech Studios owns all intellectual property rights in our games, software, artwork, characters, logos, music, and other content unless otherwise stated. 8. Third-Party Content

Our Services may allow users to submit content (such as through contact forms or future community features). If you are a user posting content to our Services, you represent and warrant that you own all rights to such content or have obtained all necessary permissions, and that such content does not infringe any third-party intellectual property rights.

If we receive a valid DMCA notice regarding user-submitted content, we will take appropriate action in accordance with this policy.

9. International Copyright Laws

While the DMCA is a United States law, we also respect and comply with international copyright frameworks, including but not limited to:

• The Berne Convention for the Protection of Literary and Artistic Works
• The World Intellectual Property Organization (WIPO) Copyright Treaty
